Administrative agreement between the German states of Baden-Württemberg, Hesse and Bavaria

The Federal State of Baden-Württemberg - represented by the Ministry of Environment and Transport - the Federal State of Hesse - represented by the Ministry of Environment, Agriculture and Forestry - and the Federal State of Bavaria - represented by the Bavarian Ministry for State Development and Environmental Affairs -, decide on the following administrative agreement:
Art. 1: Subject of the administrative agreement
- The German states of Baden-Württemberg, Bavaria and Hesse set up a common International Committee on Nuclear Technology of the German states of Baden-Württemberg, Bavaria and Hesse -ILK- (in the following named committee).
- The German states of Baden-Württemberg, Bavaria and Hesse carry the expenses for the institution and the maintenance of the committee jointly.
Art. 2: Task and work of the committee
- The committee advises the German states of Baden-Württemberg, Bavaria and Hesse independently and objectively at the very highest scientific level in the field of safety, waste disposal and risk assessment of nuclear facilities. The committee is not subject to orders of the German states of Baden-Württemberg, Bavaria and Hesse.
- Details of the committee's field of activity are laid down in the standing orders which the committee decides on unanimously.
Art. 3: Members
- As a rule the committee consists of ten members. The members are independent scientists and experts from Germany and abroad who have an outstanding national and international reputation as specialists. Within the committee they are to represent the central fields of safety, waste disposal and risk assessment adequately.
- The members are nominated by the Minister Presidents of the involved German states.
- As a rule the members are nominated for a period of three calendar years. Generally renomination in direct succession is limited to a total period of six years, except prolongation is required in an individual case for reasons of continuation.
- Each member can be recalled earlier for special reasons. The member is to be informed about the reasons. The recall must not be due to his opinion as a specialist.
Art. 4: Administrative office
At the Bavarian State Office for Environmental Protection an administrative office is established for the committee that is filled with two scientists and one administrative assistant. The administrative office assists the committee in their activities. On a scientific basis the administrative office is not subject to order.
Art. 5: The German states' coordinating committee
The German states set up a coordinating committee that coordinates the cooperation between the different German states and between the German states and the committee including the administrative office. The heads of the respective Departments of Reactor Safety belong to the coordinating committee. The coordinating committee can delegate routine matters within the respective organization to named employees. The meetings of the coordinating committee take place in Stuttgart.
Art. 6: Financing
The German states of Baden-Württemberg, Hesse and Bavaria pay each one third of the costs the committee's and administrative office's activities will cause. The respective organizations carry the costs of the coordinating committee.
Art. 7: Extension, cancellation
In general, other German states can participate in supporting the committee but mutual consent of the German states who are supporting the committee is necessary to include other German states in accordance with this agreement.
Each member State can give notice to terminate the agreement in writing with a three months´ period.
